Can I sue for harassment over Truancy?
My child has been sick quite a bit. She was in kindergarten last year and had 20 absences. Some were excused with a doctors note, and some I excused myself. One was due to a death in the family. I have been told by the attendance counselor that I have to have a doctor's excuse EVERYTIME my child is absent or bring her into school for school personnel to verify that she's ill in order for it to be excused. My issue is that not every illness requires a trip to the doctor. I can use my common sense and say, ok she has a fever and a cough so I'll give her some Tylenol and cold medicine, lots of fluids and let her rest and see how she is tomorrow. I can't take my child to the doctor EVERYTIME she's sick, resulting in co-payments, parking fees, time off of work etc... It seems like they're taking our parental rights away. I'll also mention that she has had pneumonia, and now has to be on inhalers and a steroid for lung/breathing issues which may not have occurred if she would have been allowed enough time to recover before I felt forced to send her back to school. I always thouht if the child would be out 3 days or longer a doctors note was required, but every single time seems excessive. Aldo, the school only has a nurse on Mondays so they're saying the secretary or whomever has to look at my child and say if she's really sick or not for it to be excused. I've spoken with the principle, the district, as well as the district attorney and am now seeking legal advice. I feel as though honeschooling is the only alternative vs. constantly being threatened with legal action.
